Consignment Terms & Conditions

Ichived is an online luxury resale boutique, operates from its authentication hub based in Sydney, New South Wales, Australia.

1. Application

1.1 These terms and conditions govern the consignment, sale, and handling of items (“Items”) that You deliver or propose to deliver to Ichived.

2. Appointment of Project Mirror

2.1 You appoint Ichived as Your agent to sell Your Item(s). You authorise Ichived to sell Your Item(s) in accordance with Your instructions or, where no instruction is provided, at Ichived’s sole discretion.

2.2 The minimum consignment period is 3 months, commencing from the date of contractual agreement. The period may be extended by mutual agreement.

3. Title and Risk

3.1 Title to Your Item(s) remains with You until ownership passes to the purchaser. Title does not transfer to Ichived at any time.

3.2 You warrant that:

(a) You are the legal owner and have the right to sell the Item(s);

(b) All security interests over the Item(s) have been disclosed to Ichived prior to consignment; and

(d) The Item(s) are authentic and not counterfeit or replicas.

3.3 Any Item deemed Not Authentic by Project Mirror will be returned to You. A handling fee of AUD $150 plus postage will apply.

4. Payment, Commission and Costs

4.1 If Your Item(s) sell, Ichived will issue an invoice to the purchaser as Your agent and remit payment to You (less commission and applicable fees) by direct bank deposit.

4.2 You agree to pay:

(a) Ichived’s standard commission rates as stated in your Consignment Agreement (ex-GST);

(b) Any authentication, cleaning, or restoration costs discussed and agreed upon at the time of consignment;

(c) A $150 administration fee if You terminate the consignment before the minimum three-month term;

(d) Postage costs for the return of any unsold Item(s) upon Your request.

4.3 Authentication is a mandatory step. All Item(s) will be shipped to and processed through Ichived’s authentication hub in Sydney before listing.

4.4 Any amounts owed to Ichived that are not recovered from sale proceeds must be paid prior to collecting or requesting the return of Your Item(s).

4.5 If You do not arrange collection within 3 months after being notified post-contract expiry, Ichived reserves the right to dispose of or donate the Item(s) at its discretion.

5. Termination

5.1 After the three-month minimum consignment period, either party may terminate this agreement with seven (7) days’ written notice.

5.2 Termination does not affect Your obligation to pay any outstanding amounts owed.

5.3 Ichived retains a lien over Your Item(s) until all costs, fees, and commissions are paid in full.

6. GST

6.1 If GST applies to any supply under this agreement, the applicable GST amount will be added to the consideration payable and must be paid at the same time.

6.2 Terms defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) have the same meaning here.

7. Liability

7.1 In the event of loss or damage while under consignment, Ichived’s liability is limited to the agreed consignment value at the time of sale.

8. Miscellaneous

8.1 These terms are governed by the laws of New South Wales, Australia, and subject to the non-exclusive jurisdiction of its courts.

8.2 If any provision is found unenforceable, it will be severed without affecting the validity of the remaining terms.

8.3 Failure or delay by Ichived to enforce a right does not constitute a waiver of that right.
